USING OUR WEBSITE
You agree to use our website lawfully and responsibly.
You may not:
-
use the website for any unlawful purpose;
-
attempt to gain unauthorised access to our website or systems;
-
interfere with the operation or security of our website;
-
copy, reproduce or commercially exploit our website content without our written permission; or
-
provide false or misleading information when placing an order.
We reserve the right to suspend or restrict access to the website where reasonably necessary, including where we believe that the website is being misused.
PRODUCTS
We make every reasonable effort to ensure that product descriptions, photographs, colours, sizes and other information displayed on our website are accurate.
However:
-
colours may appear slightly different depending on your device, screen settings and lighting;
-
measurements may vary slightly between garments;
-
product photographs may contain styling items or accessories that are not included with the purchase; and
-
product availability may change without notice.
Where a product is made from a particular fabric or has specific characteristics, these will be described on the relevant product page where reasonably possible.
PRICES
All prices displayed on our website are in South African Rand (ZAR), unless expressly stated otherwise.
We reserve the right to change prices at any time. However, a price change will not affect an order that we have already accepted and confirmed, except where an obvious pricing error has occurred.
If we discover an obvious pricing error after you have placed an order, we will contact you as soon as reasonably possible and give you the option to confirm the order at the correct price or receive a refund.
PLACING AN ORDER
When you place an order through our website, you are making an offer to purchase the selected products.
An order confirmation will be sent to you once your order has been received.
Your order will be processed once payment has been successfully received and the order has been accepted by us.
We reserve the right to decline or cancel an order in reasonable circumstances, including where:
-
the product is no longer available;
-
there has been an obvious pricing or product description error;
-
we suspect fraudulent or unlawful activity; or
-
we are unable to fulfil the order for reasons beyond our reasonable control.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product/order.
PAYMENT
Payment must be made using the payment methods made available on our website.
Orders will generally only be processed after payment has been successfully received.
You are responsible for ensuring that the information supplied during checkout is accurate and complete.
DELIVERY
We deliver to addresses within the areas supported by our selected courier or delivery service.
Our estimated processing and delivery times are set out in our Shipping & Delivery Policy.
Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, including courier delays, adverse weather, public holidays, strikes, peak shopping periods or incorrect delivery information supplied by the customer.
You are responsible for providing a correct and complete delivery address and contact information.
RISK AND DELIVERY
We will take reasonable steps to ensure that your order is packaged securely and handed to the relevant delivery service.
Where applicable, tracking information will be provided once your order has been dispatched.
If a parcel is delayed or appears to be lost, please contact us so that we can assist with the courier investigation.
Nothing in these Terms & Conditions limits any rights you may have under applicable South African consumer law.
RETURNS, EXCHANGES AND REFUNDS
Our Returns & Refunds Policy forms part of these Terms & Conditions.
For ordinary change-of-mind returns, we generally offer a 14-day return period, subject to the conditions set out in our Returns & Refunds Policy.
Nothing in our returns policy or these Terms & Conditions excludes or limits any statutory rights you have under the Consumer Protection Act or any other applicable law.
DEFECTIVE OR UNSAFE PRODUCTS
We are committed to supplying products that meet applicable quality and safety requirements.
If a product is defective, unsafe, materially unsuitable for its intended purpose or otherwise fails to meet applicable legal requirements, you may have statutory rights under the Consumer Protection Act.
The Consumer Protection Act provides an implied warranty of quality and, in applicable circumstances, allows a consumer to return defective goods within six months of delivery and choose the applicable remedy provided by the Act.
Where you believe that a product is defective, please contact us as soon as reasonably possible and provide details and, where appropriate, photographs of the issue.
Nothing in these Terms & Conditions is intended to exclude, restrict or waive any consumer right that cannot lawfully be excluded.
CHANGE-OF-MIND RETURNS
For an ordinary change-of-mind return, the item must generally be:
-
returned within the applicable return period;
-
unworn;
-
unwashed;
-
undamaged;
-
free from makeup, perfume, deodorant, pet hair or other marks;
-
returned with original tags attached; and
-
in a condition suitable for resale.
We reserve the right to inspect returned items before approving a change-of-mind return.
This section does not limit your statutory rights relating to defective, unsafe or otherwise non-conforming goods.
SALE AND CLEARANCE ITEMS
Sale items may be returned in accordance with our standard returns policy unless an item is clearly identified as a final-sale or clearance item.
A final-sale or clearance designation applies to ordinary change-of-mind returns only and does not remove or limit any statutory rights you may have in relation to defective or otherwise legally non-conforming goods.
INCORRECT ITEM OR ORDER
If we send you the wrong product, incorrect size or an item that materially differs from what you ordered, please contact us as soon as possible.
Where the error is ours, we will work with you to arrange the appropriate return and replacement or refund without charging you an additional delivery fee for correcting our error.
CANCELLING AN ORDER
If you wish to cancel an order, please contact us as soon as possible.
Where an order has not yet been dispatched, we will make reasonable efforts to cancel it.
Once an order has been dispatched, the cancellation may instead need to be handled in accordance with our Returns & Refunds Policy and any applicable statutory cancellation rights.
Certain electronic transactions may also be subject to statutory cooling-off rights and exceptions under applicable South African law.
